Short answer: In England it is not a legal requirement for owner occupiers to service their boiler every year. Landlords are different: the Gas Safety (Installation and Use) Regulations 1998 require a safety check on every gas appliance and flue they provide every 12 months. Boiler warranties also usually require a yearly service, so most London homes should book one.
This is one of the most common boiler questions in London, and the answer depends on who owns the boiler and who lives with it.
Owner occupiers: no legal duty
If you own the home you live in, there is no law in England that says you must service your boiler every year. You will not be fined or prosecuted for skipping a service.
That does not mean you can ignore gas safety entirely. The Gas Safety (Installation and Use) Regulations 1998 say no one should use a gas appliance they know or suspect is unsafe. And any gas work, including a service, must be done by someone competent, which in practice means a Gas Safe registered engineer.
Landlords: a yearly check is the law
For landlords, the law is clear. The HSE guidance sets out the main duties:
- A gas safety check on each gas appliance and flue you provide, every 12 months, by a Gas Safe registered engineer
- A copy of the record to each existing tenant within 28 days of the check
- A copy to new tenants before they move in
- Records kept for at least two years
- Appliances and flues maintained in a safe condition
The safety check is often called a CP12, after an old form number. Since 2018 you can have it done up to two months early and keep the original expiry date.
This matters a great deal in places like Brixton, where many Victorian houses are split into rented flats, each with its own combi. Our Brixton area page covers the conversions and lettings there.
HSE does prosecute. In October 2026 it reported a landlord sentenced for leaving a gas boiler unchecked for eight years.
The maintenance duty
The safety check is the minimum. Landlords also have a duty to keep appliances in a safe condition. HSE says there is no set timeframe for this, but good practice is to show regular, annual maintenance. Many landlords book the safety check and service together so both sit on the same date.
Carbon monoxide alarms
Since 1 October 2022, landlords in England must fit a carbon monoxide alarm in any room used as living accommodation that contains a fixed combustion appliance, such as a gas boiler or gas fire. Gas cookers are not included. The gov.uk guidance for landlords explains the rules. See our post on carbon monoxide alarm rules for more.
Warranties: often required
Even where the law does not require a service, your boiler maker probably does, if you want to keep the guarantee.
| Maker | What their guarantee terms say |
|---|---|
| Worcester Bosch | Yearly servicing is a condition of the guarantee |
| Vaillant | Boiler must be serviced annually by a Gas Safe registered engineer |
| Baxi 800 range | Annual service and maintained magnetic filter among the conditions |
| Viessmann | Annual service needed to qualify beyond the first year |
Terms change and vary by model, so always check your certificate. Our boilers we service page links to each maker’s own wording.
Insurance and boiler cover
Home insurance policies and boiler cover often have conditions about maintenance. A boiler cover policy may need a service as part of the deal, or exclude faults caused by poor maintenance. If you have cover, read the terms. A missed service is a common reason claims run into trouble.
Selling a house
There is no law that says a boiler must be serviced before you sell. But the property information form most conveyancers in England use asks about the heating system and its servicing. Buyers’ surveyors also note the boiler. See our post on whether you need a boiler service to sell your house.
Leasehold flats
If you own a leasehold flat, your lease may include a clause about servicing gas appliances. Some leases require a yearly service and proof sent to the freeholder or managing agent. This is a contract term, not a law, but it can be enforced. Check your lease, especially in purpose built blocks.
Why a yearly service is still worth it
Even without a legal duty, there are good reasons to book every year.
- Safety. The combustion test is the only measurement of what your boiler is producing. Seals and flues are checked for leaks of fumes.
- Hard water. London’s water is hard. Thames Water says all the water in its region is hard. A yearly hot water check on a combi shows scale building up.
- Fewer winter breakdowns. Worn parts and blocked condensate traps get found before the cold weather.
Who can do the work
Whatever the reason for the service, gas work in the UK must be done by a Gas Safe registered engineer. Ask to see the ID card, which shows the engineer’s photo and licence number. The back lists the kinds of gas work they are qualified to do. You can check the number on the Gas Safe Register. Our post on how to check a Gas Safe engineer walks through it.
Summary

Quick questions
Can I be fined for not servicing my own boiler?
Not as an owner occupier in England. But you may lose warranty cover, and home insurance claims can be harder if poor maintenance caused damage.
What can happen to a landlord who misses the check?
HSE can prosecute. Courts can fine landlords, and in serious cases impose prison sentences, for failing gas safety duties.
Does a gas safety check count as a service?
No. It meets the legal duty, but it does not include the cleaning and adjustment a service does.
